Increases above base rent.

(a)( 1) Notwithstanding any provision of this chapter, the lease for any rental system shall not be increased above the base lease unless:
(A) The rental unit and the typical elements remain in significant compliance with the housing guidelines, if noncompliance is not the outcome of occupant disregard or misbehavior. Evidence of substantial noncompliance shall be restricted to housing regulations offense notices released by the District of Columbia Department of Buildings and other offers of evidence the Rental Housing Commission will consider acceptable through its rulemaking procedures
